Research your idea

Determine the feasibility of your business idea and ask yourself what problem are you trying to solve. Once you have a solid idea, talk to experts such as your local Chamber of Commerce, the Houston Office of Business Opportunity, or a Harris County Partner to see how viable your idea is.

Put It On Paper

Create your business plan. Templates and help are available. Go into detail on your product/service, marketing strategies, and financial plans to include income and expense projections. Who is your management team and what does your financing look like? The completed business plan is the key to starting your business.

Location

Check with local EDO's or a local real estate agent for available properties. What kind of space do you need? Does it need to be accessible for customers? Are there any restriction on operation or required permits? Don't assume that the existence of a similar or past business means that your business will automatically be acceptable.

Investigate Names

Research the names that are being used in the area and the niche that you will be serving. Also pay attention to other similar-sounding names in your market area. Once you have a name in mind, check its availability with the Texas Secretary of State. If a corporation plans to conduct business under names other than those stated in the Articles of Incorporation, the corporation must file an 'Assumed Name Certificate' with the Secretary of State and County Clerk in which the principal and registered office of the corporation are located.

Legal Structure

The best legal entity varies for each owner and business. It is wise to consult with an attorney, an accountant, and/or a business advisor. Consider the type of business you are starting, your personal and business goals, and your personal finances when making this decision. For any legal structure other than sole proprietorship, register the appropriate documents with the Secretary of State.

Primary Check Up

It has probably been a while since you wrote your business plan. Has anything changed? Take time to review and make changes as you see fit.

Registration

All businesses must register with the state and federal government.
Determine the federal, state, and local tax obligations for your business. Apply for an Employer Identification number (EIN) with the IRS. Determine sales, use, and excise taxes. Apply for a Texas sales tax permit with the Texas Comptroller.

Finalize Paperwork

Now is the time to finalize all documents from insurance, banking, real estate, government registrations, special licenses or permits. Also review training for you and your employees.

Celebrate

Now that you've completed all the steps, you are ready to open for business.
